1. Acceptance of Terms
By accessing or using the SWIQ mobile application (available on iOS and Android), the website at swiq.services, the backend API at api.swiq.services, or any related service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use SWIQ.
We may update these terms from time to time. The latest version is always posted at swiq.services/terms. Continued use of SWIQ after changes take effect constitutes acceptance of the updated terms.
2. Eligibility
You must be at least 18 years old to create a SWIQ account or use SWIQ on behalf of a business. By using SWIQ, you confirm that you have the legal capacity to enter into a binding agreement and that using the service does not violate any law or regulation applicable to you.
SWIQ is designed for service providers and customers in India. If you access SWIQ from outside India, you are responsible for compliance with local laws.
3. Account Registration
To use certain features of SWIQ, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security and confidentiality of your login credentials.
- Accept responsibility for all activity that occurs under your account.
- Notify us immediately at support@swiq.services if you suspect unauthorised access.
SWIQ supports login via email, Google, and Apple sign-in. Each authentication method is subject to the respective provider's terms. You may not share your account with others or create multiple accounts for the same business to circumvent subscription limits.
4. Service Description
SWIQ provides appointment booking, queue management, QR-based provider discovery, live token tracking, delay updates, notifications, provider dashboards, staff tools, client analytics, and enterprise multi-location management for clinics, doctors, salons, spas, hotels, diagnostics, service counters, and other service businesses.
Key components of the SWIQ service include:
- Customer-facing features: provider discovery, slot selection, booking confirmation, live token tracking, delay alerts, and appointment management.
- Provider-facing features: availability management, service setup, QR code and provider code sharing, staff accounts, booking analytics, and subscription management.
- Enterprise features: multi-location dashboards, sub-client management, staff oversight, custom branding, API access, and dedicated account management.
SWIQ acts as a platform connecting providers and customers. We are not a party to the service agreement between a provider and their customer.
5. User Responsibilities
If you are a customer using SWIQ to book appointments, you agree to:
- Book only for genuine appointments and attend at the scheduled time.
- Cancel or reschedule in advance if you cannot attend, allowing the slot to be released for others.
- Provide accurate contact information so the provider can send booking updates and notifications.
- Treat providers, staff, and other customers with respect.
- Not misuse QR codes, provider codes, or booking links to disrupt service.
Providers reserve the right to manage their queues, modify availability, cancel bookings, and set policies for no-shows, late arrivals, and cancellations.
6. Provider Responsibilities
If you are a service provider using SWIQ to manage bookings, queues, or staff, you agree to:
- Provide accurate business information, availability, and service details on your SWIQ profile.
- Maintain your subscription and booking quota in good standing.
- Manage your team's access responsibly and ensure staff accounts are used appropriately.
- Respond to booking changes, cancellations, and customer inquiries in a timely manner.
- Comply with all applicable laws, including consumer protection, health, safety, and licensing requirements for your industry.
You are solely responsible for the services you offer to customers through SWIQ. SWIQ does not guarantee service quality, outcomes, or customer satisfaction.
7. Payment Terms
Free tier
SWIQ offers a free Starter tier that includes one provider profile, limited daily booking slots, live tracking, and standard QR code functionality. No credit card is required to start the free trial.
Paid plans
SWIQ offers Standard, Pro, and Enterprise subscription plans with increasing booking capacity, staff tools, analytics, and support levels. Paid plans are billed monthly or annually through our payment partners.
- Subscription fees are quoted in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
- Subscriptions renew automatically at the end of each billing cycle unless cancelled before renewal.
- Cancellation takes effect at the end of the current billing period; no partial refunds are provided for unused portions of the billing cycle.
- SWIQ reserves the right to modify pricing with reasonable advance notice. Existing subscribers will be notified before price changes take effect on their next renewal.
Enterprise plans
Enterprise plans are subject to separate agreements negotiated between SWIQ and the enterprise customer. Custom branding, white-label, API access, SLA guarantees, and dedicated account management are governed by the Enterprise agreement.
Payment processing
Payments are processed through third-party payment providers (including Razorpay). SWIQ does not store your full payment card or banking credentials. Payment processing is subject to the terms and privacy policies of the respective payment provider.
8. Intellectual Property
All content, software, code, designs, trademarks, logos, and materials related to SWIQ — including the app, website, API, documentation, and marketing materials — are the property of SWIQ SERVICES or its licensors and are protected by Indian and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use SWIQ for its intended purpose. You may not:
- Copy, modify, distribute, sell, or lease any part of SWIQ.
- Reverse-engineer, decompile, or attempt to extract the source code of SWIQ.
- Use SWIQ to build a competing product or service.
- Remove, alter, or obscure any proprietary notices on SWIQ.
Provider-generated content (business names, descriptions, images, and service details) remains your property. By uploading content to SWIQ, you grant us a non-exclusive licence to display, distribute, and promote that content in connection with the service.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- SWIQ is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
- SWIQ does not guarantee uninterrupted, error-free, or secure operation of the app, website, or API.
- SWIQ is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill.
- SWIQ's total aggregate liability for any claim arising from or related to the service shall not exceed the amount you paid to SWIQ in the twelve (12) months preceding the claim.
SWIQ is not responsible for the conduct, services, or actions of providers or customers, including appointment outcomes, service quality, cancellations, or disputes between parties.
10. Indemnification
You agree to indemnify, defend, and hold harmless SWIQ SERVICES, its directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to:
- Your use of SWIQ.
- Your violation of these Terms of Service.
- Your violation of any applicable law, regulation, or third-party rights.
- Any content you upload, share, or transmit through SWIQ.
- Any dispute between you and another user of SWIQ.
11. Termination
You may stop using SWIQ at any time. You may request account deletion by contacting support@swiq.services.
SWIQ reserves the right to suspend or terminate your access to the service, in whole or in part, if:
- You breach these Terms of Service.
- Your use of SWIQ poses a security risk to the platform, other users, or third parties.
- You engage in fraud, abuse, or activity that exposes SWIQ to legal liability.
- Required by law or regulatory authority.
Upon termination, your right to use SWIQ ceases immediately. SWIQ may retain certain data as described in our Privacy Policy, including records required for legal compliance, fraud prevention, and payment processing.
12. Governing Law and Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or relating to these terms or the use of SWIQ shall be subject to the exclusive jurisdiction of the courts in Jodhpur, Rajasthan, India.
Before initiating formal proceedings, the parties agree to attempt to resolve any dispute through good-faith negotiation by contacting support@swiq.services.
13. Dispute Resolution
If a dispute arises between you and SWIQ regarding these terms or your use of the service, the parties agree to the following resolution process:
- Step 1 — Informal resolution: Contact support@swiq.services with a description of the dispute. Both parties agree to attempt to resolve the matter within thirty (30) days of receiving the notice.
- Step 2 — Mediation: If informal resolution fails, the parties agree to submit the dispute to mediation before a mutually agreed mediator in Jodhpur, Rajasthan, before initiating any court proceedings.
- Step 3 — Court proceedings: If mediation does not resolve the dispute within sixty (60) days, either party may initiate proceedings in the courts of Jodhpur, Rajasthan, India, as specified in Section 12.
Notwithstanding the above, SWIQ may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.
14. Miscellaneous
- Entire agreement: These Terms of Service, together with the Privacy Policy and any applicable Enterprise agreements, constitute the entire agreement between you and SWIQ regarding the use of the service.
- Severability: If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
- Waiver: Failure by SWIQ to enforce any right or provision of these terms shall not constitute a waiver of that right or provision.
- Assignment: You may not assign or transfer these terms or your SWIQ account without SWIQ's prior written consent. SWIQ may assign its rights and obligations without restriction.
- Force majeure: SWIQ shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including natural disasters, government actions, internet disruptions, or power outages.
- Notices: SWIQ may send notices regarding the service to the email address or phone number associated with your account. You may send notices to support@swiq.services.
